Terms of Service

Acceptance
By accessing or using the Postkit service, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the service. These terms apply to all users, including API consumers, dashboard users, and SMTP relay users.
Service Description
Postkit provides a transactional email API, SMTP relay, inbound email processing, webhooks, and related developer tools. Postkit is designed for transactional and application-generated email. We are not an email marketing platform — bulk unsolicited email is strictly prohibited.
Your Account
You are responsible for maintaining the security of your account and API keys. Each organization may maintain one Postkit account. You must provide accurate and complete billing information. You are responsible for all activity that occurs under your account, including emails sent via your API keys.
Acceptable Use
You agree not to use Postkit to:
- Send unsolicited bulk email (spam) or emails to purchased, rented, or scraped recipient lists.
- Send phishing emails, distribute malware, or engage in any form of fraud.
- Violate the CAN-SPAM Act, GDPR, or any applicable anti-spam legislation.
- Transmit content that is illegal, harmful, threatening, or infringing on third-party rights.
- Attempt to circumvent rate limits, abuse the API, or interfere with the service.
We reserve the right to suspend or terminate accounts that violate this policy, with or without notice depending on severity.
Service Levels
We target 99.9% uptime for the Postkit API, measured monthly. Scheduled maintenance windows are announced at least 48 hours in advance via email and our status page. Service level commitments do not apply to the Free tier. Detailed SLA terms are available in your service agreement for paid plans.
Payment & Billing
Postkit is billed monthly in EUR. All prices are exclusive of VAT, which will be applied where required by law. Usage exceeding your plan's included volume is charged at the published overage rates. Invoices are due within 14 days of issue. We reserve the right to suspend service for overdue payments after reasonable notice.
Intellectual Property
You retain all ownership of the data and content you transmit through Postkit. We claim no intellectual property rights over your email content, templates, or contact data. Postkit and its associated platform, API, documentation, and branding are the property of [Company Name]. Our SDKs are open source and licensed under the MIT License.
Limitation of Liability
To the maximum extent permitted by applicable law, Postkit's total liability for any claims arising from or related to the service is limited to the fees you paid to Postkit in the 12 months preceding the claim. Postkit is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, regardless of whether we were advised of the possibility of such damages.
Termination
Either party may terminate this agreement with 30 days written notice. We may suspend your account immediately if you violate these terms, particularly the Acceptable Use policy. Upon termination, your data will be deleted within 30 days. You may export your data at any time before termination via the API or dashboard.
Governing Law
These terms are governed by the laws of Austria. Any disputes arising from these terms shall be resolved in the courts of Vienna, Austria. If you are a consumer within the EU, you retain any mandatory protections provided by the consumer law of your country of residence.
Changes
We may update these terms from time to time. We will provide at least 30 days notice for material changes via email. Your continued use of the service after the changes take effect constitutes acceptance of the revised terms. If you do not agree with the changes, you may terminate your account before they take effect.
